Drone Photography Rules in Spain (2026): What Property Owners Need to Know

Aerial drone shots are one of the highest-ROI additions to any Costa del Sol property listing — but Spain has some of the strictest drone rules in Europe. Here's what you, as a homeowner, agent or Airbnb host, need to know before hiring anyone to fly over your property.

Spain follows EASA rules — and enforces them

Since 2021 Spain applies the EU-wide EASA drone framework, administered locally by AESA (Agencia Estatal de Seguridad Aérea). Commercial drone flights — which includes real estate photography — require the pilot to be:

• Registered as a drone operator with AESA
• Certified under at least the A1/A3 Open category (basic) or A2 for closer flights near people
• Carrying valid third-party liability insurance (minimum SDR limits set by EU 785/2004)

Where you can (and can't) fly on the Costa del Sol

Large parts of the Costa del Sol sit inside controlled airspace — especially near Málaga Airport (LEMG) and Gibraltar (LXGB). Areas that need special authorisation or coordination include:

• Torremolinos, Benalmádena, most of Málaga city — inside Málaga CTR
• La Línea, San Roque and much of Sotogrande — near Gibraltar airspace
• Any flight above 120 m AGL, at night, or over crowds
• Natural parks like Sierra de las Nieves

Marbella, Estepona, Benahavís, Nueva Andalucía and most inland towns are generally straightforward for A1/A3 flights with the right pilot and equipment.

What to check before hiring a drone photographer

If someone offers "cheap drone shots" without asking about the address, that's a red flag. A legitimate operator will:

1. Ask for the exact address to check airspace on ENAIRE Drones
2. Fly a properly registered drone that's legal for the category of flight
3. Have liability insurance — ask for a copy of the certificate

Getting this wrong isn't just a paperwork risk. Fines for illegal commercial drone flights in Spain start at €60 and go up to €225,000 for serious airspace violations, and they can fall on the property owner as well as the pilot.

Do you need permission from neighbours?

You don't need neighbours' consent to photograph your own property from the air, but Spain's data-protection rules (LOPD-GDD) mean you must avoid capturing identifiable people or neighbouring interiors. Good operators frame shots to your plot and exclude anything else.
