Spain follows EASA rules — and enforces them

Since 2021 Spain applies the EU-wide EASA drone framework, administered locally by AESA (Agencia Estatal de Seguridad Aérea). Commercial drone flights — which includes real estate photography — require the pilot to be:

• Registered as a drone operator with AESA
• Certified under at least the A1/A3 Open category (basic) or A2 for closer flights near people
• Carrying valid third-party liability insurance (minimum SDR limits set by EU 785/2004)

Where you can (and can't) fly

Some parts of Spain sit inside controlled airspace or near restricted zones, where special authorisation is required before a commercial flight. Any flight above 120 m, at night, or over crowds also needs a different setup. A properly licensed operator checks the airspace for each specific property before flying, so you don't have to worry about it — in practice, most residential locations along the Costa del Sol are straightforward for a certified pilot with the right equipment.
